'I was out of beer': DUI suspect also charged with vehicular assault

CHURCH HILL — A Hawkins County man who allegedly attempted to run over another motorist who was attempting to prevent him from leaving the scene of an accident is scheduled to appear in Sessions Court Wednesday on charges including aggravated assault.

The alleged assault occurred on the afternoon of Aug. 9 at the Central Plaza Shopping Center parking lot in Church Hill.

CHPD Officer Isaac Hutchins was dispatched to the scene shortly before 1:30 p.m. on a report that a driver, later identified as Roby Patton Calhoun, had struck another vehicle and was attempting to leave the scene.

A female occupant of the vehicle he had allegedly struck had reportedly stepped in front of Calhoun’s vehicle in an attempt to stop him and inform him that police were en route.

Calhoun then allegedly attempted to “run over the female,” Hutchins stated in his report.

Calhoun was attempting to exit the parking lot onto South Central Avenue when Hutchins arrived and conducted a traffic stop.

Calhoun, 75, 515 Woodvue Ave., Church Hill, reportedly smelled of alcohol when confronted by Hutchins.

When asked why he hit a vehicle and attempted to leave the scene, Calhoun reportedly replied, “That (expletive) pulled out in front of me.”

Calhoun allegedly admitted having had a “couple” of drinks, and when asked what he drank he stated, “The only thing there is to drink: Busch.”

When asked if he had ever been convicted of DUI, Calhoun reportedly stated, “I have been arrested in every state for drinking and driving, and I have been to jail 15 or 20 times.”

When asked why he was driving that afternoon, Calhoun reportedly replied, “I was out of beer.”

Calhoun was charged with aggravated assault with a motor vehicle, DUI, no insurance and violation of the Habitual Motor Vehicle Offender Act. He is currently free on $7,500 bond pending his court appearance Wednesday.
