Couple suing Mount Carmel over police crash

ROGERSVILLE — A Mount Carmel couple rear-ended by a Mount Carmel police officer who was responding to an emergency call in Church Hill last year has filed a $150,000 lawsuit against the city seeking compensation for damages.

The accident occurred Nov. 3, 2012 while MCPD Officer Bobby Moffitt was en route to assist the Church Hill Police Department on a home invasion call which was initially dispatched as a home intruder with a gun. It was later revealed that the homeowner actually had the gun, but that wasn’t known until after the wreck occurred.

Shortly before reaching the Church Hill city line, Moffitt rear-ended a 1995 Toyota in the westbound passing lane of Highway 11-W.

The Toyota was driven by Helen Lawson of Mount Carmel, and her lone passenger was her husband, Claude Lawson.

Both Lawsons are listed as plaintiffs in the lawsuit, which was filed Thursday in Hawkins County Circuit Court by their attorney, Mark D. Harris. The town of Mount Carmel is listed as the lone defendant in the Lawsons’ lawsuit.
