Man lying in roadway with gun not charged with DUI despite confession

MOORESBURG — A Bean Station man allegedly found lying in the road unconscious near a loaded pistol and his pickup truck was charged Friday morning with public intoxication and a weapon charge. 

Daniel Mack Marshall, 28, 688 Rocky Summitt Road, Bean Station, wasn’t charged with DUI, however, despite allegedly admitting he had driven drunk and run his pickup off the road. 

Sheriff Ronnie Lawson said a DUI charge would have required a deputy seeing Marshall in control of the vehicle.

Shortly before 8 a.m. Friday, Hawkins County Sheriff’s Office Deputy Josh Byrd responded to a report of a 1996 Dodge Ram 1500 stopped partly on the roadway on Hickory Nut Lane off of Isenburg Road in Mooresburg.

Upon his arrival, Byrd found the vehicle, but a short distance away he also reportedly found a man lying face down in the roadway as well.
