Ordinance would require future PUD developers in Rogersville to post bond

ROGERSVILLE — Developers who propose future Planned Unit Developments in Rogersville will be required to post a bond equal to the proposed construction cost before the city will approve the project thanks to a new ordinance approved on second reading Tuesday by the Board of Mayor and Aldermen.


Since adopting Planned Unit Development (PUD) zoning in city code a few years back, Rogersville has approved three PUD projects.


The first project was abandoned, and the second project was cut short of the original plan with the leftover acreage sold off.


Steve Nelson, Rogersville building inspector, told the Times-News that a third PUD located off Park Boulevard has been the subject of ongoing scrutiny by the city because the developers failed to complete some required construction.


“There was a retaining wall between that property and the gas company that has never been built,” Nelson said. “They had a time frame to build it and didn’t meet it. They also didn’t put the finished coat on the street. There’s isn’t a top coat on the blacktop.


“What this ordinance does is require the developer to put up a bond, and if they don’t finish the project, there would be money to finish the job. If it’s a million dollar project, the developer would require a million dollar bond.”


The Park Boulevard developer will not be required to buy a bond. The ordinance only affects future PUDs.


“We didn’t have any teeth to go after the (Park Boulevard) developer, and if he goes under and walks away from it, all those people are stuck with an unfinished road,” Nelson said. “This ordinance ensures that we won’t find ourselves in this situation in the future.”


The third and final reading of the ordinance will be considered by the BMA at its May 14 meeting.


In other business Tuesday the BMA:


•Approved the second reading of an ordinance that limits the size of signs on building walls. Although Rogersville has sign regulations, in the past there were no regulations for sign size on a building outside the historic zone.


According to the new ordinance, wall signs in non-historic business districts will not exceed 15 percent of the total area of the building facade where the sign is located and shall not exceed 100 square feet.


•Approved a resolution reinstating the $50-per-meeting pay for members of Rogersville’s Planning Commission, Parks Recreation Board, Water Commission, Beer Board, Board of Zoning Appeals, and any other city committees or commissions. The $50 pay for those members was cut from the budget a few years back. The cost of reinstating the pay is estimated at $7,000.


•Agreed to meet in Budget Workshop on April 23 at 4 p.m. to begin work on the 2013-14 fiscal year budget.
