Death of fetus in East Knoxville shooting could bring second slaying charge

KNOXVILLE — Authorities today said they erred when they told police no charges could be filed in connection with the death of a 13-week-old fetus carried by a teen killed in East Knoxville.

"We made a mistake but corrected it fairly quickly," Knox County District Attorney General Randy Nichols said when asked about a new law regarding the death of a fetus.

The News Sentinel initially reported charges could be brought in connection with the death of the unborn child. The story was changed when Knoxville Police Department spokesman Darrell DeBusk, based on what prosecutors told him, said the law did not support a criminal charge because the fetus was not viable.
