Police arrest Kingsport man for aggravated assault; claims he was using ball bat to chase away man who wanted to buy drugs

A Kingsport man, arrested after allegedly beating a baseball bat against an apartment complex, tells police he was chasing away an individual attempting to buy drugs.


The man told police he is not a drug dealer, and was "infuriated" he had been asked if he had any to sell.


The incident occurred 12:50 a.m. Sunday, at 808 Burwind Court. A police report says officers spoke with the resident of apartment No. 4, Ervin Dale Lane. Lane told police that prior to their arrival, the posts and building outside his door were beat upon by his neighbor, armed with a baseball bat.


Lane said that when he looked out his front door his neighbor grabbed him by face and pushed him back inside. When Lane again approached the door his neighbor allegedly, "took a fighting stance with the bat, and threatened to strike him."


Police spoke with the suspect, David B, Cook, 37, of apartment No. 5. Cook advised that someone had come to his residence wanting to buy drugs, which he does not sell.


"Cook advised that he then chased the subject with a bat," reads the police report.
 
Cook said his neighbor, Lane, was not the person looking to buy drugs. However, he told police the man had ran into Lane's apartment.  


Police report that while they were present, no one else was located inside Lane's apartment.


In Cook's apartment they found a baseball bat. Police say it was "extremely damaged" and "marked with paint matching the poles in front of Lane's apartment."


Cook was arrested and charged with one count of aggravated assault.
