Hawkins County grand jury indicts HIV patient accused of raping mentally challenged woman

August 25th, 2008 12:00 am by Jeff Bobo

ROGERSVILLE — The Hawkins County grand jury returned a four-part indictment Monday against an HIV patient accused of raping a mentally challenged woman earlier this year.

Kenneth Dale White, 46, is scheduled for arraignment Friday in Hawkins County Circuit Court on charges including rape, aggravated kidnapping, aggravated burglary and criminal exposure to HIV.

The incident occurred the evening of March 9 when White allegedly kicked in the door of a residence of a 53-year-old woman whose husband was away at work.

Investigators alleged that White barricaded himself and the woman into the residence, coerced her into undressing, and based on forensic evidence, raped her.

Assistant Attorney General Doug Godbee told the Times-News Monday that the victim has been tested for HIV but has not come back positive as of yet. Godbee added, however, that regardless of whether the deadly virus is spread to the victim, by law HIV/AIDs patients who knowingly engage in sexual contact with a person are guilty of criminal exposure to HIV, a Class C felony.

When the victim’s husband arrived home from work the night of the attack, he allegedly observed White in bed with his wife. According to reports the victim’s husband beat White, who then escaped and ran out of the house as the victim’s husband paused to call 911.

The HCSO found White not far away at a church, although White’s clothes were still at the victim’s home.

According to reports, the woman and her husband had never associated with White, although White had reportedly been told in the past to stay away from the victim’s residence. White is known to police for numerous alcohol-related arrests, and he was allegedly intoxicated during the March 9 events.

White remains lodged in the Hawkins County Jail on $125,000 bond.
