Brothers charged with raping 5-year-old; suspects' father charged with failing to register as a convicted sex offender



ROGERSVILLE - Hawkins County authorities charged two teenage brothers with rape of a 5-year-old child Wednesday.


And Hawkins County Sheriff Roger Christian said when the boys' father came to the sheriff's department to see why his sons were in custody Wednesday, he was arrested for failing to register as a convicted sex offender.


Christian said the conviction of Daniel Ross McClellan, 41, 323 Shepherd Chapel Road, Rogersville, occurred in Florida, but Christian didn't know exactly what the charge was.


McClellan's sons, ages 14 and 19, are accused of raping a 5-year-old girl.


The older brother, Daniel Robert McClellan, is charged with two counts of rape of a child and was being held Wednesday in the Hawkins County Jail on $100,000 bond.


The 14-year-old brother is charged with one count of rape of a child and is currently in state custody.


The three rapes are alleged to have occurred on three separate dates in March. The child told an adult, and that adult reported the allegations to the Hawkins County Sheriff's Department.


The Department of Children's Services conducted an investigation as well, Christian said.


"We have interviewed Daniel Robert (McClellan), we have a statement from him, and as a result we have charged him," Christian said. "It's just a terrible crime, especially when you see that little girl. She's just as cute as a button."


Christian said the father was not under suspicion of any crimes when he came to the sheriff's department.


"He was here inquiring about his sons' case, at which time we found out that he was an unregistered sex offender living in our county," Christian said. "The officer told me that during the process of interviewing this was brought out."


Daniel Ross McClellan remained lodged in the Hawkins County Jail Wednesday evening on $5,000 bond.
