Court records name GOP analyst in Web campaign against Nathan Vaughn

A restraining order was issued two months ago to a person identified as a Tennessee House GOP research analyst accused of using the Internet to allegedly defame state Rep. Nathan Vaughn of Kingsport, the Times-News has learned.

Court filings noted the Web content placed Vaughn “in a false light,” but there were no specific descriptions of what it said or looked like.

Vaughn, a Democrat, lost his re-election bid last week in a contentious 2nd House District campaign to Colonial Heights Republican Tony Shipley by 326 votes or about one percent of the total votes cast.

As a result of Vaughn’s loss and other House seat pickups by Republicans, the GOP now has a 50-49 majority in the state House.

House GOP Leader Jason Mumpower, who backed Shipley, predicted last week he would get the votes from Republican lawmakers this January to become the first Republican House speaker since the 1960s.

The restraining order was issued September 11 in Sullivan County Circuit Court listing defendant Scott Gilmer to be forbidden from using Web domain names associated with Vaughn such as www.nathanvaughn.com, www.nathanvaughn.net and www.nathanvaughn.org. The domain names were registered with GoDaddy.com.

State election law says this type of communication in the candidate’s name is supposed to be authorized by the candidate, his campaign or his representative. A violation of this law is a misdemeanor.

The Web content, according to the court filings, did not identify the persons who paid for and authorized the sites.

Gilmer, identified as the research analyst, was also identified as an aide to House GOP Caucus Chairman Glen Casada of Franklin.

Neither Mumpower nor Gilmer immediately responded to e-mails and phone calls seeking comment.

When Vaughn was asked why he didn’t speak about this during the campaign, he replied: “Wasn’t there already enough negative stuff out there?”

During the campaign against Shipley, Vaughn was the object of a number of political attacks, including one Tennessee Republican Party direct mail piece that electronically pasted a picture of his head on a black bird.

Vaughn, elected as Northeast Tennessee’s first African-American state lawmaker in 2002, was portrayed in the direct mail piece as “part of the liberal, big government flock” with President-elect Barack Obama and U.S. House Speaker Nancy Pelosi.

Losing GOP presidential nominee John McCain bested Obama by 41 points in Sullivan County – more than 26,000 votes.

The 2nd House District includes parts of Kingsport, Colonial Heights, Indian Springs and Sullivan Gardens.

Are you kidding me??? Le'Michelle, who gave you the right to spit hellfire and brimstone?? Did God appoint you as the representative for racism? YOU get over it. If YOU PEOPLE hate East Tennessee so bad, YOU PEOPLE can hop on the next ship back to Africa! If YOU PEOPLE hate white people so bad, YOU PEOPLE know where Africa is, just don't go to South Africa cause guess what? White people are there too. YOU PEOPLE always want to play the race card. White people are almost becoming a minority because YOU PEOPLE don't know how to use birth control. How do you like me now?? If YOU PEOPLE think that by calling racism will get you a free lunch or something, YOU PEOPLE might as well forget it.
YOU PEOPLE cry racism at every corner. Now, I just wanted you to see how you feel when the tables are turned. Racism was another time and another place and it should stay that way. Now is the time for UNITY. Forget that guy who said God will kill you if you are a republican! One more issue. If YOU PEOPLE forgot, there is no United Caucasian College Fund, and no minority loans. And if you are an Employer and you have a colored man and a white man, applying for the same job, tell us who gets it! Not the white guy. That's the racism of today. YOU PEOPLE won't let go of something you have not experienced(slavery). So come on and act like a responsible, upstanding member of society and help work out these problems with our country instead of causing the problems!

When did I advocate starting any website or condone this one? All I said was the other side needs to be senstive to dishing out personal attacks if they don't like them. Who brought up race

I really feel the need to interject something here. Whether you are a republican or democrat. Whether you are from this area or not. The elections are over. Condeming someone to hell is something I would be afraid to even think about doing. Throwing God and bible verses into the mix is dangerous. I do not pretend to know all about the bible. I know I read it. And not just certain parts that will make me feel better about myself or allow me to condemn others. I know I pray and hope everyday I am doing what is expected of me. Insults, hatred and pure vile remarks are being slung on both sides. How does this look to family members of those who ran in the elections? What do their children feel like if they read this stuff? We are supposed to be adults. Using these forums is a way to express your thoughts and opinions. Both sides are wrong for saying such hurtful things. People, we heard what we wanted to during the elections. We, myself included, did not take enough time out to think what would be at stake for anyone other than ourselves when making the remarks that were made. This article was pertaining to a legal matter that will be handled appropriatly. And may I suggest going to domainsbyproxy.com for those who did not understand how this could have been done legally.

I did see these websites early on in the campaign because I went to the wrong one at first. This began because Mr. Vaughn wanted to work on a web site for his insurance business. When he attempted to do so, he found his name was already owned by someone other than himself. Also known as a domain by proxy. What was on these sites were unapproved images and false statements made by someone pretending to be working for Nathan Vaughn. As well a link to an e-mail that was supposed to be a direct link to Mr. Vaughn. It was not. These sites were being used as if they had been approved by Mr. Vaughn and the folks that started these sites were using his name falsely. Mr. Young, are you advocating starting a website pretending to be someone else or using someone else's name to state your own agenda? How about I open a site called JordanYoung.com and pretend to be you or pretend to know all about you? I would be able to say whatever I felt like as if you had said it yourself. Or post falsehoods, deflammatory images, etc. I could pretend to be anyone for that matter. I personally feel this is an issue of defamation of character and possible identity theft. I am not clear on all the laws about this type of situation. But, it is being taken care of legally as it should. This is not "sour grapes." At least on my part. I am not upset anymore about the election results. I was at first. But, then I figured it was time for me to put on my big girl bloomers and get over it. I am not questioning Mr. Shipley's win or how he won. I am hoping he will do great things for us. This situation was not brought up during the campaign by Mr. Vaughn simply because he did not want it to take away from the other issues. That proves to me he is a true statesman and a gentleman. Kingsport Times News was unaware of any of this before the election. They found out through their own sources only in the last couple of days. Public court documents are available to newspapers as well as anyone else. No-one knew if Mr. Shipley had any knowledge of these sites. Therefore, it was not going to be an issue in the campaign.

You know you people here are really either racist or stupid. Here you all want people to "GET OVER IT" but it seems funny how NONE of you people have any concerns about the racial attacks on Nathan Vaughn, during the election. The GOP, these people that got us in so much mess, and NOW Obama is going to have to get YOU PEOPLE out of it, I find it very offensive that the GOP candidates and workers would place Vaughn's head on a Black Chicken. How would YOU WHITE PEOPLE like to be racially put on a mail poster and placed in the United States Mail for people to see? But NO, you are God's greatest gift to men. Right! I'm ashamed of you people, and I think that all of you that speak your trash on this forum and had voted republican in this election, you're going to get what you all deserve, without the help of your prediction of saying that Obama is gonna hurt your pocket. You have already hurt your own selves greater than you'll ever know. You know, I was told a few years ago from a very important person of this community that is also a business owner, they told me that Kingsport and the republicans of this area will go to any length to get ugly, just to win office. You know, that person was right. But the sad part is, most of you people with your so-called know-it-all political education, you're so freaking out of it until it's people like you that's going to cause the whole nation to suffer. Yeah, that's right, you call yourselves, most of you, CHRISTIANS, and yet you hate black people like sher hell. And then you want people to move here to live, BUT I notice how things are really changing for you Upper East Tennessee people. Just watch! I don't rely on the President to know who is for me, I just know that over the record history of this nation, white people has ALWAYS been fearful of "PEOPLE of COLOR", as some would use the phrase. And since I see so many people talk trash, this friend isn't what I prefer to say publicly, but I'm sick of seeing you people tear down the other races of this community. You act like YOU SPEAK for ALL the WHITE'S of the community, but as for me, YOU DON'T, and by the way, I'm NOT BLACK either, just for the record. I just hope I never run for office, but I won't, because this area is not where I prefer to be noticed. Thank you for your time, and I do hope I bother your minds all night and day long. I feel really badly for Nathan, but there are bigger and better things in store for him. As for Kingsport, you will reap what you have sewn. In regards to the GOP, if they continue in existence, it will be a bleak one. The party of principles is in a shambles. Just look at their leaders. Wow. What a legacy.

Ladies and gentlemen, this election is over! Mr. Shipley won and MR. Vaughn lost. It's time to get over it and move on.If there were anything shady going on that could have been proven, this pro Nathan/pro Kingsport newspaper would have had it on the front page! All these attacks on Mr. Shipley are uncalled for. He's not even been sworn in yet and people are already trying to trash him, but to some that's ok. He's NOT a Democrat! I'm sure MR. Vaughn is a good and decent man, but his paling around with Jimmy Nafeah and the rest of the western Tennessee Democrats and forgetting his district reached further than the Kingsport city limit signs caused his defeat. Look at the bright side! With the Leutenant Governor AND the Speaker of the House being from Sullivan County, MAYBE the folks in Nashville will recognize that Tennessee doesn't stop at the Knoxville and we'll finally get our fair share of the pie!

You guys are cracking me up. There's no meat at all to this story except for a court order about some websites. What was on these sites? Anything? If it made that much of a difference the Times-News would know what was there because it would have shaped the election. It seems some of you have forgotten how the Democrats had a plane full of opposition researchers touching down in Alaska hours after Sarah Palin was chosen as McCain's running-mate digging up negative materials. It seems some of you have missed me, too. Indeed Jimmy Naifeh is a liberal and that section of the road at Carolina Pottery is in fact not in the second district. Feel better? Frankly your comments are insulting - you're insinuating that a majority of the people of the second district are unable to form their own opinions, shouldn't be able to vote from their own thoughts and research, and they're sheep being led around by soon-to-be-Speaker Mumpower and Lt. Gov. Ramsey. Race was not an issue in this campaign. Period. Get off of it. The only "fear tactics" used were a fully documented comparison of their stances on issues. If talking about how somebody voted incites fear in the electorate then maybe we do need to think about a change in our representation. That might be why a majority of voters picked Shipley over Vaughn. It sure is a sad day for our area when we now will have both key legislative positions representing our area. Boy, we're just going to fall apart at the seams from all of that extra attention (read: legislative priority). I know for a fact that Rep-Elect Shipley has already started working for his district and you will indeed be seeing the difference here very shortly. The election is over, folks, and it's time to move on. Give Tony a chance. If you have a problem or want something addressed, call his office - they've already assigned him a contact number (615-741-2886). You can't bash him and say how much better a job Vaughn did merely a week after the election and two months before he's even sworn in. What do you even have to compare yet?

I am utterly and completely shocked that the GOP, the party of principles, would do such a thing. Surely you jest! Maybe Jordan Young will come on now and tell us Jimmy Nafieh is a liberal or that that road doesn't run through Vaughn's district. Shocked I tell you....shocked.

Ramsey and Mumpower remind me of a low-class Bush and Cheney. I'm sure that statement would simply tickle them pink as well. Mumpower refuses to answer any inquiries into his dirty campaign tactics, which I'm quite sure were responsible for some of the Shipley camp's trash-mailings. Mumpower has had his hand in a few questionable campaigns, while refusing to comment. Ramsey, on the other hand, is so busy trying to forward his own personal career and agenda that he didnt bother to even campaign this year. Regardless of what he predicted the outcome to be, he's become a bit "too big for his britches."

I admire Nathan Vaughn for not playing into these negative smears. It is sad that it lost him the electiion. Nathan was a great state Rep, and did many things for many people, everyone in the district knew that if you wanted something done, or felt like you had been dealt with unfairly, just call Mr. Vaugn. It is sad that we cannot think for ourselves, and play into the whole race/fear tactics of others. The ones to suffer in the long run are the people of this district. I would question anyone who would use illegal tactics to gain a position. We will miss Mr. Vaughn, and the people will not know how much until they see the difference.
