Defeated Republican incumbent U.S. Rep. David Davis moved toward challenging his narrow GOP primary loss to Johnson City Mayor Phil Roe on Monday by suggesting that “some outside groups” may have tried to “improperly influence” the primary.
Davis said he has hired a national law firm that has worked on recounts to examine the issue.
“It does appear there has been some voting irregularities in the Republican primary,” Davis said. “It does appear Tennessee election law may have been violated. We are working with a constitutional law firm to protect the voting rights of Republican primary voters. This is not about David Davis or Phil Roe. This is about the sanctity of the voting process, which must be protected.
“There were a lot of Democrats voting in the primary. Tennessee law prohibits crossover vote unless you intend to have loyalty to that party.”
Roe said he was confident that his winning 486-vote margin would stand and noted he’s gotten a congratulatory letter from Tennessee Republican Party (TRP) Chair Robin Smith.
Tennessee law allows for a recount if there is an indication of voter fraud.
State Elections Coordinator Brook Thompson said the Roe-Davis primary result could be state certified about a week after Aug. 18, following certification actions taken by county election commissions.
Afterward, Davis could put the recount issue before TRP’s Primary Board.
In 2006, the board unanimously voted to deny 1st Congressional District GOP runner-up Richard Venable’s request for a recount in his 576-vote loss to Davis.
Venable contended that many voters were beset by problems at polling locations.
“The lines were so long and the voting was so slow. There was a question that voters were disenfranchised and left,” Roe recalled.
The 1st Congressional District hasn’t elected a Democrat in more than 100 years.

Here we go again another whiny Republican screaming no fair. Stomp my feet and whine. So I guess if Mr. Davis has his way we will go to the voting booth and all you get to do is check Republican or Democrat and we Independents just have to sit on the side lines. I personally vote for the person that I think will represent me the best and you Mr. Davis I could not wait for your time to come. The people of East Tennessee have spoken so just fade away.
There is an irony here somewhere. If you remember the last primary election two years ago, Mr. Venable would probably have won but the Sullivan County voting machines were not working correctly and the lines were extremely long. Many voters walked away without voting. Had those machines worked correctly on that day, Mr. Davis may have never even had the opportunity to be a congressman. He should savor the his last two years and remember one thing, when you represent the first district, you have to represent everyone. Mr. Jenkins and especially Mr. Quillen knew that. Hopefully, Dr. Roe will remember that.
Mr. Davis, you lost the election because you blatantly ignored the voices of Democrats in your district- So it's not surprising Democrats probably pulled a Rush Limbaugh Operation Chaos on you. Be a good sport, concede the election, and endorse your opponent. And don't let the door hit you on the way out.

If this article is any indication it appears that the TRP has decided that Roe is the primary winner and sent him a congratulatory letter. Davis' reaction to his defeat shows me what I've suspected for a while about him. That he is not the good Christian man he portrayed himself to be in his campaign commercials but a small, self centered, almost egomaniacal man who thought he had inherited the congressional seat he occupied and could run it as he pleased till he died. The people have spoken Mr. Davis get over it.
Kudos Carolyn Harper! A game of Monopoly with a disgruntled former congressman...sounds like an ebay charity auction! I do not understand how the election laws can prohibit "crossover votes" without violating all "secret ballot" laws in the process.
It is probably the oil companies' contributions being used to try to steal an election from the people by hiring these Washington attorneys to contest our election. We have spoken! Go back to your health care business, Mr. Davis! Sarge
This has got to be the most ridiculous 2008 election year I've ever seen in my whole life. To think that republicans are sore losers in more than one way, but to suggest that some outsiders would try to sway votes away from the GOP to get the democrats the votes? This is stupid. Mr. Davis is a wimp and a sore looser, and a big supporter of the Bush administration. My gosh, just to know that America is still suffering from war pains, job closers, insurance cuts, no benefits on jobs, and the list just keeps going on and on. America will always be in debt as long as the republicans continue to fuss about loosing to the democrats. I mean, after all, they blame the democrats for spending foolishly, and yet they put our country in harms way, just for a lie of a personal problem with Saddam Hussein. And he wasn't even our main problem. Old man Bush did the same thing, and what did Bush Jr. do? The same thing. What did the republicans do? The same thing. What's that? Mess up, not fix up, and won't shut up. But just keeps on pointing the finger at the other person. Mr. Davis, you lost, so get over it, and stop wasting our tax dollars playing stupid. Get over it.
Im simply shocked. Mr. Davis is blatanly stating that he represented the Republican voters of East Tennessee. The job of congressman is to represent the people of East Tennessee, regardless of what color and animal you chose to affiliate yourself with. I find it simply extraordinary that this man DID represent the good folks of this area in such a partisan, political, and self-serving manner. We the people should have the right to revoke this man's pension and health care for tarnishing the 1st District Congressional seat.

Baloney Mr. Davis, which is exactly why you hired a "national law firm" in an outlandish attempt at saving face. YOU LOST. USTED PERDIO.
