Church Hill man in a jam over alleged peanut butter vandalism

Published March 5th, 2008 | 1 Comments

A Church Hill man is in a legal jam after allegedly spreading peanut butter on a Kingsport man’s couch.

Kingsport police responded to a verbal dispute at 820 Fairmont Ave. on Saturday and found that the homeowner, Jim Monk, had confronted a trespasser who had allegedly “spread peanut butter all over his couch,” according to an affidavit filed in Sullivan County General Sessions Court.

The trespasser was identified as Mark Anthony Herron, 34, of 4915 Carters Valley Road.

A note included in court records accused Herron of various deeds — though not all were criminal in nature.

His stepfather may lose a finger after Herron bit him — an alleged action he faces an assault charge over, the note says. He’s also accused of choking his mother. Both have taken out orders of protection against him, and his entire family is afraid of him, it continues.

Herron has been banned from his previous place of employment because of an alleged altercation with another employee, the note continues. He was also kicked out of Hope Haven for repeated violations, it says.

Herron apparently hasn’t been taking his medications for over a year and has been hospitalized twice since Dec. 28, 2007, according to the note. After the last time, he “came out as manic as he went in,” the note says.

Over the span of about a week and a half, Herron also allowed his car to run out of gas “at least 10 times,” according to the note. The name of Herron’s brother, Chuck Herron, is listed at the end of the note, but it was not immediately clear whether the information in the note was provided by Chuck Herron or collected by an investigator.

Kingsport Police Department Officer Robert Mills said in the affidavit that Mark Herron said he did spread the peanut butter over Monk’s couch. Herron offered no explanation as to why he did it.

The second point in the note says that mental health officials told him “the only way to get him help was through being arrested.”

Herron was arraigned Monday. No bond was set at that time.

Herron has a March 11 court date on charges of criminal trespassing and vandalism.
