GREENEVILLE — A Mexican man who has been deported from the United States twice in the last 13 years received an 80-month federal prison sentence earlier this week for unlawfully being in the country.
Ricardo Sanchez-Lopez, 47, received an 80-month prison sentence and three years of supervised release Monday in U.S. District Court in Greeneville. In addition, U.S. District Judge J. Ronnie Greer recommended that Sanchez-Lopez receive 500 hours of intense drug abuse treatment while incarcerated.
According to the prosecution Sanchez-Lopez, who was living in Johnson City at the time, was arrested in Hawkins County earlier this year on an aggravated assault charge. After local law enforcement sent his fingerprints off to be checked, information came back about Sanchez-Lopez being in the country illegally.
The matter was then transferred to federal court, where a grand jury in February charged him with knowingly and unlawfully being found within the United States.
The sentencing memorandum filed by the prosecution states Sanchez-Lopez has persistently engaged in criminal behavior during his entire adult life and since his illegal entry into the United States. In addition, it said Sanchez-Lopez has repeatedly re-entered he United States illegally and continued his criminal activity.
Court records state Sanchez-Lopez never entered the United States legally; that on April 28, 1994, he was deported at Laredo, Texas; and he was deported again on May 1, 1997.
Sanchez-Lopez had charges out of Sullivan County and Scott County, most of which were misdemeanor charges. Greer said in open court that many of Sanchez-Lopez’s prior offenses involved alcohol abuse, which was a great concern to the court.
The sentencing memorandum states Sanchez-Lopez has been convicted of 12 charges involving alcohol abuse and four convictions for crimes involving assaultive behavior.
A federal prosecutor said the reason why Sanchez-Lopez was able to avoid deportation was because after a local sheriff’s office would arrest Sanchez-Lopez for public drunkenness he would give them an alias instead of his real name. By the time his fingerprints came back with his real identity, Sanchez-Lopez was already out of jail.
For misdemeanor charges, a federal prosecutor said local law enforcement would not have held Sanchez-Lopez until the fingerprint check returned. Over the years Sanchez-Lopez used six different aliases, court records state.
Sanchez-Lopez has asked to be assigned to a prison facility in Texas. The prosecution stated after Immigration and Customs Enforcement conducts a due process hearing, Sanchez-Lopez will be deported again.

In case you haven't hear Rachael, we incarcerate those who are citizens and commit crimes, as Michael Vick will soon learn. Is our system perfect? No. But we by and large put peoples rear ends in jail when they violate the laws. That is why there is prison crowding. No small proportion of that number are illegal aliens who have committed a vast array of crimes, just like every other prisoner in the system. I would like to congratulate you on graduating tops in your class. You could have put that education to better use by reading the article. The man was here illegally. He was in violation of our LAWS. Not only was he here illegally, but he was violent. Definition: illegal: Contrary to law or official rules. That is from Webster. What is so difficult for people of your persuasion to understand? But you still have not answered my questions. What of the millions who wish to come here? Should we take them all in? If not then how many? Are you the one who will choose who we let in? What are your criteria for those who stay as opposed to those who cannot? You want to be fair don't you? Should you permit the Mexican, yet deny the Chinese? Why ? What are the standards? Please tell me... I am sure we would all like to know. The fact is we have every right to tell those who come here in violation of our laws to go home. We are a sovereign nation. Remember, we declared our independence in 1776... even fought a war. I believe I read that somewhere. Oh yes, history class and American government. They have a real big shin dig every July 4th, in case you didn't notice. But we cannot remain sovereign by allowing mass unfettered immigration. History is filled with nations who lost there identity by permitting mass immigration.I am against illegal immigration by any race or nationality. If a man comes here he must become an American. Not a Mexican American or Japanese American. You cannot have divided loyalties.United we stand, divided we fall. The policy that you believe in will signal the death knell for our sovereign nation. But no, you consider us bigots just for stating truths. We cannot sustain the current flow of illegal immigration.
I am not ashamed as you put it, Dale St. John. I am PROUD TO BE AN AMERICAN. I would serve my country in a heart beat if I could. What I said was not to diss my country but the ignorant people who think they own this land. Mexican, Chinese, Japanese, Ethiopian, Malaysian, Peruvian, English, German, French, and every other culture out there, has as much a right to freedom as we do. If you come to the United States, then yes, you should succumb to its laws; the same as if I were to go to their country. But on the same token, we have natives to this country that break the laws and think they are above reprieve. The law applys to everyone, not just one group of people. Not being from Tennessee, I have learned that no matter what Hispanic culture you are-you are considered to be Mexican, why is this? People only see what they want to see. When we have a white person commit a crime, do we tell them to go back to their own country? No we don't because this is their country. But when a person of different nationality commits a crime the first thing everyone says is SEND THEM BACK TO WHERE THEY CAME FROM. A crime is a crime no matter what country, religion, or nationality you are from. Oh, and for Mr. White, I graduated top of my class in a Private School located in the heart of the metropolitan area outside of Washington, D.C. more than 15 years ago.
Ms. Morgan what part of illegal do you not understand? There is a difference between legal and illegal. Look around you lady..this nation now has 300 million people. It is a far cry from the land that out forefathers found which was inhabited by a few thousand natives...not Mexicans, but Cherokee, Apache, Comanche, Pueblo and the list goes on. There were no great cities like New York or Chicago. No highways or dams. No hospitals or schools.By the way in case you did not know, the native Americans fought wars amongst themselves for hunting lands, a fact that you seem to be ignorant of. Yes wars...they killed each other. Some tribes killed all the males of the losing tribe and enslaved the females. The Apache fought wars against the Mexicans over land and even led raiding parties deep into Mexico. That is when the Mexicans encouraged the "gringos"... that is your"English" ancestors and mine.. to settle into Texas, to be used as a buffer against attacks by the Apache and other tribes. This is a part of history that you are not taught in school, but it is true and verifiable. We do not have the space or economic capability to continue to absorb the current flow of illegals into this country. This isn't 1620... it is 2007. 300 million plus. To continue to absorb at the rate we are will put America on the path to becoming a third world nation. So you want to be fair and let who wants to immigrate in? There are 1 billion Chinese and 1 billion Indians. Millions of which want to live here. Not to mention those from other areas such as Africa. So lets be fair and let them in!!! Don't you want to do that? Wouldn't that be the fair thing? After all they just want a better life for their families..right? What right do we have telling them they can't come here, huh? Why not... are you a bigot? Don't you want them here because they are Chinese and Indians and not Mexican? C'mon be fair, Hell, let Em all in. If you don't think we should let them in, then you call the shots... where do we cut off the flow and who will it be? Are you starting to see why we need immigration laws? Can you see why we must enforce them? We must have laws by which they must enter at a controllable rate so we can maintain order and a way of life that has taken 300 years to develop. We should not allow more in than can assimilate (that means learn our language, laws and customs) in a reasonable amount of time. Why? Because they are not schooled in our way of government. We have a government based upon the Magna Carta, the English tradition of law, as well as German and other European laws. It is an important part of who we are and it does make a difference. That is why they must be educated in our way of law and life. Why is Mexico such a mess that everyone wants to leave? Because of there tradition and system of government. It is deeply rooted in the Spanish way of government which up until recently was far different than other European systems as well as ours. We are a proud Nation and have every right to be. If you are ashamed then perhaps you should move somewhere that you can feel proud. We,for you information, have brought more freedom to more people around the world than any other nation. We have brought more prosperity to the world than it has ever known. We have fed peoples who cannot feed themselves. We have cured previously incurable diseases. We have landed on the Moon and have returned, not once but many times. No other nation has done this.We perfected mass production. We have produced some of the greatest minds the world has seen.We produced Jefferson and Washington. Lincoln and both Roosevelts. The list goes on. All of this in just over 200 years. So go ahead and hold your head in shame. I will hold mine up proudly and say despite our faults, we have been and still are the greatest nation on the face of this earth. No other comes close. So take some Mylanta if you are sick and remember that what ever you have and what ever you will aspire to be, you owe it to this nation... America, and all those who came before you, that you despise. It is a dirty shame that anyone could forget the sacrifice they made in order for you and I to have a better life than they did.
Poor Rachael, it's obvious you're a recent victim of a public school education. You ask "What right do we have to tell another human being of a different nationality to go back "home". When that human being's first act in our country is to break our law by sneaking across our border, that person is a scofflaw. We as a nation have the right to demand that people coming here obey our laws, not obey only the laws they choose to obey. Wouldn't you agree with that?
"Our once proud land". You've got to be kidding me. This land has never been proud. We are all here because our ancestors raped, murder, stole, and every other criminal act there is - for US Americans to live here. What right do we have to tell another human being of a different nationality to go back "home". They immigrants are here for the same reason our forefathers came to this country....a better life for their families. A chance at freedom. A chance to be something other than a dog for their government to use. When I hear the American people talk about sending the immigrants back to their country it makes me sick to my stomach. We were immigrants once and don't forget it. The Pledge of Alligence states.."one nation, under GOD, indivisible, with liberty, and justice for ALL."
A tip o' the hat to Mr. Francis. I couldn't have said it better myself. :-)
Paul
The justice system in this country is a joke, when they prosecute the victims of crimes and protect the criminals, there is a real problem.
Dave,Dale St. John,Chuck and Greg I applaud you for saying everything that I feel when it comes to ILLEGALS in this country. I wished that more Americans would get angry enough to make our so called elected officials do their jobs. I have written everyone that I can think of and to me they are just blowing me off with some sort of answer that I don't feel is good enough. ACTIONS SPEAK LOUDER THAN WORDS and until they start doing something I will continue to write them. ILLEGALS have earned how I feel about them. They are a leech off of our society. Go home and let your President take care of you. If he can not, hold your protest and over throw him and get out of our country. By the way, do us a favor and take the ACLU with you. Before they go, they should read what our President Teddy Roosevelt has to say about becoming an TRUE AMERICAN!!! Check at LOU DOBBS WEBSITE.
America has gained a huge criminal element, because our borders in both the North and South remain open in catering to the so-called free trade agreements. U.S. citizens have been sacrificed in the name of profit and greed on behalf of the corporate cartels that have deep pockets and easy access for our politicians. In reading the final paragraph of this commentary, you will find unsuppressed and honest links. You will find the truth; the overwhealming mayhem and disaster from (DUI) on our highways from illegal foreign drivers EACH DAY. You will read about everyday gang murders committed by M-13 that is spreading across our once proud land. Their are soundbytes and videos of those who appose the 25 plus million illegal alien invasion. You will learn to join the voices of many demanding employer sanctions and deportation. We will reverse this silent war or we will be Americans no more.
My question is regarding the huge illegal immigrant exodus from Arizona, Oklahoma and othe states that are beginning to enact strict employer sanction laws? My guess it will be LOS ANGELES, CALIFORNIA! Why might you ask? Because it is a "Sanctuary City" that under Order 40, police officers are not allowed to enquire about the citizen status of an illegal alien.
What is going to happen, when the majority of Californian citizens realize they are supporting the hordes of foreign nationals migrating their from other states? When they find they are subsidizing the employers who use cheap labor? when they find their state taxes are rising because of the influx of ex-Oklahoma, Arizona illegal newcomers, who need medical attention, housing, food stamps, childrens schooling and of course more prison space. Do something about it yourself. Because it will not belong, before they start occupying your town or community. Demand that your Mayor and his elected officials have their law officers instructed by (ICE) Immigration and Customs Enforcement, trained to enforce immigration laws. In addition, contact your (hired help) state Governor, Senators and their capitol representatives to legislate laws similar to Oklahoma, New Jersey (Maybe) and Arizona.
Tell your family members, friends and co-workers to become "Whistleblowers" ; keep their eyes and ears open for illegal activities in workplaces. Do not let illegal employers ignore the growing momentum of ordinary citizens to stop these travesties of the "RULE of LAW." While Americans are subject to arrest, fines and even imprisonment, big business seems completely untouchable by our legal system--UNTIL NOW! As yet I do not know for sure whether its "Smoke and Mirrors" or the enforcement of the workplace is going to be strictly enforced. Just like building the barrier between our corrupt Southern neighbor and us, supposedly mandated by this administration, we have to wait and see? Hardly any construction has been done yet, but for an overview go to www.americanpatrol.com.

Please do not sit on your hands, do something! Because the job you are saving may be YOURS? Each day our way of life is being eroded, our flag, our language and our Magna Carta, THE U.S.Constitution of these United States.
Well, its a start. We have enough drunks of our own with out having to worry about Mexico's drinking problems. Are they going to kick his butt out after he pulls his sentence, or give him a pat on the back? No, they will probably treat him like pie and maybe even find an office he can run for. Not that he would do any worse than some of our elected officials.
The justice system in this country is getting to be like a comedy. Why would you even consider sentencing an illegal alien to 3 months of supervised release? Would his parole officer have to travel to Mexico too?
