Lax enforcement of federal immigration laws is driving much of the concern over immigration issues in Tennessee, according to a state Comptroller's report released Wednesday.
"The state is limited in its power to control immigration. The power to regulate immigration is exclusively federal," said the report, which also noted that federal law specifically limits state and local efforts to establish more stringent requirements regarding immigrants' employment and immigration law enforcement.
The report told Tennessee lawmakers to consider encouraging the federal government to take a "stronger role" in controlling and funding services for the estimated 100,000 to 150,000 illegal aliens in the state.
State lawmakers introduced a number of bills during 2006 and 2007 to limit illegal aliens' access to employment, as well as to public benefits and services.
Representatives of state trade associations interviewed by the Comptroller's Office of Research said most businesses want to follow federal laws to verify employees' immigration status, but added it is not easy to detect false documents. The report pointed to a 2005 Government Accountability Office finding that document and identity fraud "make it difficult for employers to comply" with verification.
The report stressed that economists say immigrant workers are beneficial to economic growth, and that illegal aliens are not taking jobs or significantly affecting native workers' wages.
As for expenses, the report found taxpayers mostly pay for illegal aliens at the state and local levels. For instance, federal law requires Tennessee schools to admit all students regardless of their immigration status. In addition, public schools must provide services to non-English language proficient students. All students can also qualify for free and reduced-price lunches and other school assistance programs based on family income.
But illegal aliens, said the report, are not eligible for most public benefits.
"The cost of public benefits provided to unauthorized aliens are primarily restricted to elementary and secondary education and emergency and public health care as required by federal law," said the report. "State and local governments have some increased costs from the incarceration of unauthorized aliens for criminal behavior ... (but illegal) aliens contribute to state and local revenues ... through sales taxes on goods purchased, property tax through payment of rent, as well as other user taxes such as those on gasoline. They are not able to access public services such as TennCare (the state's Medicaid program), housing, food stamps, welfare and lower cost higher education."
The report said only U.S. citizens who are Tennessee residents can get a state driver's license, and noted the law does not distinguish between illegal aliens and U.S. citizens who commit crimes in the state.
"After serving their sentences, the federal government may deport any foreign-born convicts, including authorized or unauthorized aliens," the report said. "Local law enforcement and corrections agencies have indicated frustration at the lack of response from the federal government in picking up criminal unauthorized aliens for possible deportation when eligible for release."

Kingsport cannot arrest illegal aliens, because they have no money to pay into the coffers of the police department. Ossifer Dale Farmer and his "buddies" are only interested in arresting folks who have money or nice cars,, so they can get a new car for themselves,, these cars should be given to the schools and all funds recovered placed into the general fund...
It is a conflict of interest to give cops or their department the money they confisicate,,,,,in the real world it is illegal, known as RICO....

If are laws would be enforced, the ones that come here legal and learn ENGLISH and abide by the law, and not leech off of any government or state assistance would not encounter this problem. The problem they (illegals) have created is they won't learn ENGLISH and abide by the law, they think they are entitled to rights that they do not have. Mary Smith I have a real problem with your views on this matter.Iam a hard working american woman with a real hard working husband.Until may of 2006 when someone ran him down with there van and he no longer can be that hard working white american man.NO WE ARE NOT RACIST, but you say you work for social service you tell me how we can't get help.I'm the only one working now we have a 18 year old son but we don't claim him on a case load but we are told we have to (HOW).The system can give illegals food stamps,welfare,and health insurance to them,but us americans that have worked hard fo rwhat we have got are discrimated against for having a few resorces oh I forgot there not and I quote jack pot babies.So tell me where is the help for us and many more like us,The help should start with americans that are here by birth we founded this country.this system is truly wrong but go figure were only white.Have a nice day.We will survive some how,with out the goverments help.

If there really is a fervor against hispanics as you say, it's not an irrational fervor. The vast majority of illegal aliens coming into this country (approximately 2 out of 3) are Hispanic, so as a group they've earned the scorn they receive. As a group, they have worked hard to subvert our laws and our sovereignity and take advantage of our good nature.
Again, you throw up racism. Again, I'll ask you, is "Hispanic" a race of people? Or is "Hispanic" a linguistic designation? You complain about the rhetoric of immigration but your use of labels is as wrong as those you condemn.

Here's the problem...with all of the fervor against illegal immigration, particularly focused on the hispanic population, people are becoming increasingly hostile toward hispanics in general, whether they are legal or not. What is a legitimate social and political issue in some places is becoming an overzealous hate movement across the country. I breaks my heart to hear tales from friends, who worked hard to come to this country legally, about the hate speech they encounter almost daily. The rhetoric of the whole thing is wrong. It is breeding racism and hate.

You see Ms. Smith, if the laws had been enforced in the first place,it would not have gotten to that point. But they were not; because people did not at first see it as a problem. Every body saw the cheap labor and didn't see the bad side of the issue. The point is that people don't want those problems in their own towns. We have enough problems of our own without having more thrust upon us. So that makes us racist huh? What part of illegal do you not understand? No one in this forum has stated having a problem with LEGAL immigration. And believe it or not, legal immigrants from Mexico are every bit as Mexican as illegals are. You know, there are probably at least 1/2 a billion Chinese who would be here if they lived close enough to sneak through the border. Why not just bring them on over, as well as any other folks who want to immigrate.Oh say, maybe a billion or so. Why not just throw our immigration laws out? Would you be happy then? After all, we are all immigrants aren't we? That is the excuse that is used. The point is that our health care system is being bankrupted, and our legal system stretched to the breaking point. I have a novel idea... why don't we only let folks immigrate LEGALLY? But it is predicated upon the person's becoming an American, and nothing but American...There can be no divided allegience here. Any man who says he is American, but something else also, isn't an American at all. We have room but for one flag, the American Flag...We have room but for one language here, and that is the English language...and we have room for but one sole loyalty and that is the loyalty to the American people. What "racism" are you talking about? Are "immigrants" a "race"? Is enforcing immigration law "racism"? What are you talking about?
It absolutely disgusts me to see this new generation of racism growing in our country. I can understand certain communities around the nation taking issue with illegal immigration, particularly those closest to the Mexican border, where there are real problems with drugs coming in and social services are truly strained. However, I know first hand that these issues are of little, if any, consequence in this region. Working in social services, I have met the illegals everyone seems to want to debase. They typically work at least two, if not three jobs. They have strong family ties and work hard to make a better life for their children. As for social services, they usually just want/need medical care for their kids because they can't find employment anywhere that offers it. Frankly, their morals and work ethic impress me, particularly in contrast to the "entitled" mentality of many American citizens who seek social services. I commend anyone willing to work hard to make a better life for their child and have no patience for anyone too lazy to. But, then again, I guess for some, sitting in free housing and drawing a check is a better life than picking tomatoes or laying block. Before we start trying to run off all the illegal immigrants, I suggest we figure out how we're going to motivate anyone else to do the jobs they're filling.

As ar as ID's SSA/DSS requires a legal Birth Certificate.Valid SSA Card.Valid DMV computer generated Picture I.D with a state approved control number only obtainable after they check the Social Security Number which is generated once applied for by the legal parents of that child.Hospitals require both an insurance card,valid Picture ID.
So as for illegals using fake ID theirs a website each SSN can be checked to see if the individual is legally deceased since SSA requires a Legal Death Certificate signed by the Physician doing that. SSA as of 2004 was changing the SSA cards as they told the wife and I whereas you don't carry them with you in your wallet.They are only intended for financial transactions, not to be on a Drivers License,or Legal ID.Need the employment process regulations per ADA,PL-101-336 Title I,II,III,IV,or V? No matter what a city/community pays to enforce immigration laws, it will never outweigh the costs/expenses of the illegals being there---plus their anchor babies!! Once they have anchor babies (also known as jackpot babies)---they then become eligible for ALL social benefits---welfare, WIC, foodstamps, medicare, low income housing, etc. Plus, illegals are using fraudulent documents or stolen identities to apply for those benefits even without the anchor babies.
If a city/community is serious about enforcing immigration laws---they will have some/all of their police trained and certified through the 287(g) program---which is offered through ICE/Dept of Homeland Security. This is a LEGAL means to be able to enforce immigration laws through arrests and deportations. The program costs $520 per officer and the training is only 5 weeks long. DEMAND that your city/community participate in the 287(g) program. If they do not---file a class action lawsuit anytime a citizen is seriously hurt by an illegal or one of their children!!
You know, I don't care what "economists" say and how many reports they generate in an attempt to prove their point that immigrant workers aren't affecting jobs or pay for Americam workers. Replacing American workers with foreign workers is NOT good for our citizens or our payscale, and that's not just the illegals but also the visa workers brought in to do white-collar jobs. American workers are being cheated, but you'd better keep paying your tribute (taxes) for the honor of being cheated.
