Couple facing charges in theft of FedEx package containing five iPhones

ROGERSVILLE — Hawkins County deputies are looking for a Morristown man who allegedly stole a FedEx package containing iPhones that his girlfriend had accepted for a neighbor.

HCSO Detective Ken Sturgill said the five Apple iPhone 5s with accessories that arrived Wednesday morning for Cloie Tucker of Clover Circle in Mooresburg had a value of $5,000.

Tucker told the HCSO she was at Walmart when the FedEx package arrived, however, and her neighbor, Heather Lynn Swartfiguer, 26, 256 Clover Circle, Mooresburg, had signed for he package.

When Tucker returned home, Swartfiguer told her the package had arrived.

“Mrs. Tucker then asked for the package, at which time Heather could not produce the package, and stated she didn’t know where the package was,” Sturgill said. “(Swartfiguer) stated that she had placed the package on the table near the garage of her house, and then went to take the trash out.”

Swartfiguer reportedly told Sturgill that when she returned she noticed the package was gone, as was her boyfriend, Ryan Kimbrough, 33, of Morristown.

Tucker then notified Verizon and discovered the phones had been activated.

As of Thursday afternoon Kimbrough was wanted by the HCSO on an arrest warrant for theft over $1,000.

Swartfiguer was charged with being a party to theft based partly on the content of text messages she and Kimbrough allegedly sent back and forth after the theft.

“He took the phones, but she was there and didn’t stop him,” Sturgill said. “He texted her on his own phone and admitted that he had taken the iPhones. He texted her to say he took the phones and ‘I’m sorry I got you into this, I’ll take the charge and get you out of it.’ She texted him back saying ‘the police are here now,’ and ‘why did you do it, come on back.’ He said ‘have them call me’ and she texted back ‘absolutely not’.”

The phones are also still missing.

Swartfiguer was released on $500 bond and she is scheduled for arraignment Monday in Hawkins County Sessions Court.
