Judge rejects city's attempt to quash BVU lawsuit

Tricities.com is reporting that Circuit Court Judge Larry Kirksey has rejected the city government's request to dismiss a suit that seeks to derail the creation of a Bristol, Va. Utility authority.The judge agreed with the plaintiffs’ attorney, David Hutton, that questions raised by the litigation should be heard in court. City residents Lonnie and Jeanette Whitley filed the suit in November, seeking to invalidate an October City Council vote asking the Virginia General Assembly to create the authority.BVU is currently a division of the city that manages its electricity, water, wastewater and OptiNet telecommunications services. The controversial plan, opposed by some residents and council members, would create a separate governmental entity outside of direct oversight by the city.Read the full report at the Tricities.com .
